This Acceptable Use Policy defines the permitted and prohibited uses of Portcast's services.
1. Overview and Scope
This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of Portcast Media Limited's ("Portcast") agency ad account support services (the "Services"). This AUP forms an integral part of our Terms of Service. By using our Services, you agree to comply with this AUP. Capitalised terms used but not defined in this AUP have the meanings given to them in our Terms of Service.
We reserve the right to update this AUP at any time. Continued use of our Services after changes take effect constitutes acceptance of the updated AUP.
2. Permitted Uses
Portcast's Services are available exclusively to qualified performance advertisers. To use our Services, you must:
- Operate a legitimate performance advertising business with verifiable business registration and a bona fide advertising need.
- Comply with all applicable advertising platform policies, terms of service, and community standards for each Platform on which you advertise.
- Use all Ad Accounts in your own business name under the account delegation model, as defined in our Terms of Service.
- Provide accurate, complete, and current information during the Fit Review process, onboarding, and throughout the duration of your engagement with Portcast.
- Use our Services solely for lawful purposes and in accordance with all applicable laws and regulations.
3. Restricted Verticals
Portcast does not support and will not provide Services to businesses operating in the following verticals or categories:
- Gambling and Betting: Including but not limited to casino, sports betting, poker, lottery, bingo, daily fantasy sports, and any other form of gambling or wagering.
- Adult Content: Including but not limited to pornography, adult entertainment, escort services, adult dating, and any sexually explicit material or services.
- Illegal Goods and Services: Including but not limited to drugs, drug paraphernalia, prescription drugs without a prescription, weapons, firearms, ammunition, and any goods or services the sale or promotion of which is illegal under applicable law.
- Platform-Prohibited Verticals: Any vertical, category, or business type that is prohibited by the advertising policies of any Platform on which you intend to advertise.
- Other Restricted Verticals: Any other vertical or category that Portcast, in its sole discretion, determines to be incompatible with its risk tolerance, compliance obligations, or business model. Portcast may update this list at any time without prior notice.

4. Prohibited Activities
You agree not to, and agree not to permit any third party to, engage in any of the following prohibited activities:
4.1 Platform Policy Circumvention
You may not use our Services or any Ad Account to circumvent, bypass, or violate any Platform's advertising policies, content policies, terms of service, or community standards. This includes but is not limited to cloaking, misrepresenting landing page content, using misleading creatives, or engaging in any practice designed to evade Platform review or enforcement mechanisms.
4.2 Misrepresentation
You may not misrepresent your business, your products or services, your advertising content, your intended use of our Services, or your compliance status. This includes providing false or misleading information during registration, Fit Review, onboarding, or at any other time during your engagement with Portcast.
4.3 Unauthorised Account Activities
You may not buy, sell, rent, lease, or otherwise transfer Ad Accounts or access to our Services without Portcast's prior written consent. You may not use any Ad Account for the benefit of any third party without full disclosure to and consent from Portcast.
4.4 Reselling and Redistribution
You may not resell, redistribute, sublicense, or otherwise make our Services available to any third party without Portcast's prior written consent.
4.5 Unlawful Activities
You may not use our Services for any unlawful purpose or in furtherance of any unlawful activity, including but not limited to fraud, money laundering, terrorist financing, sanctions evasion, or any activity that violates applicable anti-corruption or bribery laws.
4.6 Technical Abuse
You may not interfere with the operation of our Site or Services, including by: introducing viruses, trojans, worms, logic bombs, or other malicious code; attempting to gain unauthorised access to our systems; conducting denial-of-service attacks; or using automated means to access, monitor, or copy content from our Site without our express written permission.
5. Monitoring and Enforcement
Portcast reserves the right to monitor your use of our Services for compliance with this AUP. Without limiting our other rights and remedies, if we determine, in our sole discretion, that you have violated this AUP, we may take any of the following actions:
- Issue a warning regarding the violation.
- Require you to remedy the violation within a specified timeframe.
- Suspend or restrict your access to our Services pending investigation.
- Terminate your Account and our Services immediately and without notice.
- Report the violation to the applicable Platform, law enforcement authorities, or regulatory bodies.
Portcast retains all fees paid for Services performed in good faith prior to any violation. Portcast shall have no liability to you for any action taken under this Section.
6. Reporting Violations
If you become aware of any violation of this AUP by another user or third party, please report it to us immediately at contact@portcastads.com. We will investigate all reports and take such action as we deem appropriate in our sole discretion.
7. Changes to This Policy
Portcast reserves the right to update or modify this AUP at any time without prior notice. When we make material changes, we will notify you by posting a notice on our Site or by sending an email to the address associated with your Account. Your continued use of our Services after any changes constitutes your acceptance of the updated AUP. We encourage you to review this AUP periodically.
